Terms of Service

The agreement between you and us: what you get, what you owe, and what happens when either side wants out. Written to be read, not to be survived.

1.This agreement

These terms are a contract between you and Guestate, of Budapest, Hungary, who operates Guestate (“we”, “us”). They apply when you create an account or use the service in any way.

Our Privacy Policy forms part of these terms. If you do not accept both, please do not use the service.

2.Who can use it

You must be at least 18 and able to enter into a contract. If you are signing up for a company or another person, you confirm you are authorised to bind them, and “you” means them as well as you.

3.Your account

Accounts are created by signing in with Google. Keep your Google account secure: anyone who can sign in as you can edit or delete everything in your portals. Tell us promptly at guestate@gmail.com if you think someone else has access.

Keep your account details accurate. You are responsible for everything done through your account.

4.What the service does

Guestate lets you build a guest portal for a rental property and generate QR codes that point at it. Because the printed code points at the portal rather than at the content, you can change the content whenever you like without reprinting anything. You also get a dashboard showing how often your portal and its tools were opened.

Portal links are unlisted, not secret. Anyone with the link — or a photo of your printed code — can open your portal and read what is on it. There is no password on a portal, by design, because guests are not asked to sign in. Do not put anything there that you would not be comfortable making public.

We may add, change or remove features. If we remove something you depend on, or make a change that materially reduces what a paid plan offers, we will give you reasonable notice and you may cancel under section 8.

5.Your content

Everything you put into the service is yours — property details, house manuals, recommendations, images and the rest. We claim no ownership of it.

You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and display that content, purely so that we can run the service: show it to your guests, generate your QR codes and back it up. The licence lasts as long as the content is in your account and ends when you delete it.

You confirm you have the right to publish everything you upload, and that doing so does not infringe anyone’s rights or breach any obligation you owe to a third party — including your own duties under data-protection law for anyone else’s details you publish.

6.Acceptable use

You agree not to use the service to:

  • publish anything unlawful, defamatory, hateful, sexually explicit, or infringing someone’s intellectual property;
  • distribute malware, or link a guest to a site that would harm them;
  • impersonate anyone, or misrepresent your connection to a property you do not have the right to list;
  • scrape, probe, overload or reverse-engineer the service, or work around its rate limits, plan limits or access controls;
  • resell or white-label the service without our written agreement;
  • offer a guest anything in exchange for a review, or otherwise misuse the review hand-off.

8.Plans, billing and cancellation

The plans

Starter is free and covers one property, one shop item and one local recommendation, with overall analytics only and a small Guestate badge on your portal. Host is €19 per month and covers up to three properties with unlimited shop items and local recommendations, per-property analytics including item and page click tracking, and no badge. Portfolio is €49 per month and covers unlimited properties with analytics across all of them, and no badge. The pricing page sets out what each plan includes, and is what applies when you subscribe. Prices are in euro and exclude VAT, which is added where it applies to you.

Payment

Payments are processed by Stripe. We never receive your full card number. By subscribing you authorise us, through Stripe, to charge your payment method the plan fee on each renewal date.

Renewal and cancellation

Paid plans are monthly and renew automatically until cancelled. You can cancel at any time from Settings; the plan then runs to the end of the period you have already paid for and is not renewed. We do not refund part-months, and we do not charge a cancellation fee.

If a payment fails we will retry it and let you know. If it stays unpaid we may downgrade your account to the free plan.

What happens on downgrade

If you end up on a plan that allows fewer properties than you have, nothing is deleted. We keep the properties your plan still covers — the ones you created first — fully live. Any beyond that number are paused: their guest portals serve a short holding page instead of your guides, and you cannot edit or resume them. Your shop items and local recommendations work the same way: everything you saved is kept, and guests see as many as your current plan covers.

There are two ways back, and both take effect immediately: upgrade, or delete properties until you are within the limit. Everything that was paused returns exactly as you left it. You can still view and delete a paused property at any time.

The codes for your covered properties keep working. Cancelling or downgrading does not break the code on your fridge for the properties your plan still covers — those portals stay live on the free plan, badge and all. Codes for paused properties still scan, but show the holding page until you upgrade or free up a slot.

Price changes

We may change our prices. We will give you at least 30 days’ notice by email before a change affects you, and you can cancel before it takes effect.

Your right of withdrawal

If you are a consumer in the EU you normally have 14 days to withdraw from a distance contract. By subscribing and getting immediate access to the paid features, you ask us to begin performance during that period and acknowledge that you lose the right of withdrawal once the service has been fully performed. Where it has only been partly performed, you pay for what you used up to the point of withdrawal.

Nothing in this section affects your statutory rights if the service is faulty.

9.The free plan

The free plan is provided as it is, with no service level and no guarantee that it will remain free or unchanged. We will give notice before withdrawing or materially reducing it. Portals on the free plan carry a Guestate badge.

10.Availability

We work to keep the service up, but we do not promise it will be uninterrupted or error-free, and we give no uptime guarantee. We may take it down for maintenance, ideally at quiet times and with notice where we can. Because your guests reach your portal over the public internet, some of what affects availability is outside our control.

If the service is materially unavailable for a sustained period, your sole and exclusive remedy is a refund or credit of the fee for the affected month, at our option. Ask us by email and we will not argue about it. This is the one exception to the no-part-months rule in section 8.

11.Things outside our control

We are not in breach of these terms if something outside our reasonable control stops us performing — an outage at a provider the service depends on, a network or power failure, a change in the law, or anything of that kind. We will tell you what we know and get things back as soon as we can. If it lasts, either of us may cancel.

12.Third-party services

The service relies on Google for sign-in and Stripe for payments, each under its own terms. The review tool hands your guest off to your Google Business profile, and the recommendation tool sends them to sites you choose. We do not control those destinations and are not responsible for them.

We are not affiliated with, endorsed by, or connected to Airbnb, Booking.com, Google or any other platform. We mention them only to describe what the service is for. Complying with your listing platform’s own rules is your responsibility.

13.Our intellectual property

The service itself — the software, design, name and logo — belongs to us and stays ours. These terms give you a limited, non-exclusive, non-transferable right to use it while your account is open. The QR code images we generate for your properties are yours to print, display and distribute however you like.

14.Suspension and termination

You can stop at any time by deleting your account in Settings. That permanently erases your account, your properties, your QR codes and their history, and your printed codes will stop working. There is no undo and no backup we can restore from.

We may suspend or close an account that breaches these terms, defrauds us, or puts the service or other users at risk. Except where the breach is serious or unlawful, we will warn you first and give you a chance to put it right. If we close your account without cause, we will refund any unused part of a period you have paid for.

15.Warranties and liability

The service is provided as it is. To the extent the law allows, we exclude all implied warranties, including that the service will be fit for a particular purpose or that the analytics figures are exact — they are estimates, and the dashboard explains how each is counted.

We are not liable for indirect or consequential loss, however caused — including lost profit, lost bookings, lost reviews, lost goodwill and lost data. Where we are liable, our total liability to you, for all claims taken together, is limited to €50.

Keep your own copy of anything you would not want to retype. We take backups to run the service, not as a backup service for you.

Nothing here limits what cannot be limited. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law of Hungary does not permit us to exclude. If you are a consumer, your statutory rights are unaffected by this section.

16.Indemnity

If someone brings a claim against us because of what you published through the service, or because you broke these terms or the law, you will cover our reasonable losses and legal costs in dealing with it. We will tell you about any such claim promptly and will not settle it without asking you first.

17.Governing law and disputes

These terms are governed by the law of Hungary, and the courts of Hungary have jurisdiction. If you are a consumer resident elsewhere in the EU, this does not deprive you of the protection of the mandatory law of your own country, and you may also bring proceedings in your local courts.

Please email guestate@gmail.com first — most things are quicker to fix than to argue about. EU consumers may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

If any part of these terms turns out to be unenforceable, the rest still stands.

18.Changes to these terms

We may update these terms as the service changes, and the date at the top will change with them. For material changes we will give hosts at least 30 days’ notice by email or in the dashboard. If you keep using the service after a change takes effect, you accept it; if you would rather not, cancel before then.
